Terms and Conditions of Sale

ARTICLE 1: PURPOSE
These General Terms and Conditions of Sale (GTC) and Terms and Conditions of Use (TCU) establish the rights and responsibilities of Focus Scale Ltd, trading as Global Institute of Management Excellence (GIME), hereinafter referred to as “the company,” and its customers, in the context of the online sale of international management and business training courses through its website www.gime-institute.org.
ARTICLE 2: PURCHASE CONDITIONS
Customers must be at least 18 years old and have the legal capacity to make purchases of training courses, or obtain the consent of a legal guardian if they are minors.
When placing their order, customers must provide accurate and complete information via the form available on the company’s website. This includes all necessary identification information for order processing.
The accuracy of the information provided is the responsibility of the customer. The company reserves the right to request verification of identity, eligibility, and provided information if necessary.
ARTICLE 3: PRICING
3.1 Currency used:
The rates displayed on the digital portal of the company are expressed in British Pounds Sterling (GBP). All transactions are processed in GBP through our UK-based payment systems.
For international customers, currency conversion may apply through their bank or payment provider. The company is unable to guarantee the absence of potential additional bank charges billed to the customer for international transactions.
It is the responsibility of the customer, if they wish, to contact the company to verify the final amount in their local currency prior to any product purchase.
3.2 Payment methods:
Training payments can be made by credit card or via PayPal. Customers also have the option to pay in installments where available. By choosing a payment method, the customer authorizes the use of it to settle their order.
The company reserves the right to modify the prices of its training courses at any time. However, the rates applied will be those in effect at the time of the customer’s order.
In case of lack of payment authorization or non-receipt of payment, the company reserves the right to suspend the processing and delivery of the order. Additionally, the company may refuse to fulfill an order if the customer has unpaid invoices or is involved in a payment dispute.
3.3 Transaction confirmation:
The customer will receive a payment confirmation including the details of their purchase and the total amount including applicable taxes.
The company’s digital records will be used as proof of communications, orders, and payments made. Orders and invoices are stored securely and can be consulted as evidence.
ARTICLE 4: DELIVERY
The training will be made available to the client once payment has been confirmed. An email containing the links and necessary information to access the purchased training will be sent to the client.
The training materials will be downloadable by the client, allowing them to have lifetime access to the training. The company accepts no responsibility for any loss of these documents or loss of access codes to the personal space preventing access to the training.
Other items, such as training completion certificates, will be made available in their personal space upon successful completion of the course requirements.
ARTICLE 5: RIGHT OF WITHDRAWAL AND REFUNDS
5.1 Withdrawal Period
Customers have a withdrawal period of 30 days from the date of purchase to cancel their order. Beyond this period, the right of withdrawal will no longer be applicable.
The request for withdrawal must be clearly stated to customer service, either via the contact form available on the website or by email to [email protected].
5.2 Refund
Refund requests must be addressed to customer service and will be processed accordingly. Refunds will be made using the original payment method.
The company declines all responsibility in case of banking delays. Customers should take these potential delays into account when waiting for a refund.
The refund policy aims to ensure the integrity and fairness of the training programs.
Refunds will not be accepted in the following cases:
– As soon as the customer has completed 50% of the training
– If the customer has received their training completion certificate
– If the refund request is made after the 30-day withdrawal period
– If the customer has requested a change of training or modification of their order
ARTICLE 6: RESPONSIBILITIES
6.1 Responsibility of Focus Scale Ltd
Focus Scale Ltd undertakes to provide the training courses and their content as soon as the client has made the purchase. In the event of impossibility to provide the service due to power cuts, Internet connection problems or any other event beyond its control, Focus Scale Ltd cannot be held responsible.
Focus Scale Ltd reserves the right to perform maintenance on its website. In this case, Focus Scale Ltd undertakes to inform the client as soon as possible and to minimize the duration of the maintenance.
6.2 Responsibility of the Client:
Focus Scale Ltd provides the client with the courses and their content following the purchase. It is the responsibility of the client to understand and use these courses appropriately.
The courses offered by the Global Institute of Management Excellence are intended for personal and professional development use only. The client is not authorized to distribute or share the courses in their entirety or in part. Any modification, sharing, translation or other action of this kind, in whole or in part, for commercial purposes other than personal use is strictly prohibited.
When receiving the certificate of completion, the client is responsible for the use of the knowledge acquired through the training in their professional practice.
In the event of maintenance on the company’s website (see Article 6.1), the client undertakes not to claim any compensation or refund.
ARTICLE 7: LIMITATION OF LIABILITY FOR COURSE APPLICATION
The Global Institute of Management Excellence offers online training for educational and professional development purposes only. The company is not responsible for the direct application of the knowledge acquired by clients from these courses. When applying management techniques and business strategies, clients are responsible for their actions, decisions, and implementations within their organizations.
Clients agree to indemnify and hold Focus Scale Ltd harmless from any claims, liabilities, damages, or expenses arising from the misuse or faulty application of the knowledge, techniques, or information acquired from GIME courses. Focus Scale Ltd disclaims any liability for errors, business losses, or consequences resulting from the application of course material in a professional or business context.
Clients must ensure that their practice and the application of course content comply with professional standards and local business regulations. The courses offered by GIME do not replace the requirements for professional certification or licensing in management and business fields.
ARTICLE 8: LEGAL WARRANTY
Focus Scale Ltd guarantees the conformity of the product with the contract, subject to any legal warranty claims under UK consumer protection laws.
ARTICLE 9: INTELLECTUAL PROPERTY
Focus Scale Ltd owns the rights to use the content of the website, including text, graphics, logos, sounds, and software. Any reproduction or modification of the elements of the website is prohibited without authorization.
ARTICLE 10: PROTECTION OF PERSONAL DATA
The customer’s personal information (email address, name, etc.) will be used exclusively by Focus Scale Ltd and will not be transmitted to any third-party organization without consent. The customer has the option to request the deletion of this information in accordance with UK GDPR; however, they are aware that this will result in the permanent deletion of their access to their personal space.
ARTICLE 11: INTERNATIONAL SALES
Focus Scale Ltd offers its courses for sale worldwide. It is the responsibility of the customer to ensure that the obtained certification is recognized and valid in their country of residence or the country where they intend to use this certification. Focus Scale Ltd is not responsible for the applicability or recognition of its certifications outside the jurisdiction in which it operates and cannot guarantee the acceptance of certifications on a global scale. Customers are advised to perform the necessary checks to confirm that the chosen course meets the necessary standards and recognition requirements for their professional needs in their specific location.
ARTICLE 12: MODIFICATION OF TERMS AND CONDITIONS
The company reserves the right to modify these General Terms and Conditions of Sale and Use at any time. The changes made will be effective upon their publication on the company’s website. Customers will be informed of any changes through a notification on the website or by email. It is the customer’s responsibility to regularly consult the terms and conditions to be aware of any possible modifications.
ARTICLE 13: PARTIAL NULLITY
If a clause in these terms and conditions is declared null, illegal, or unenforceable, it will not affect the validity or enforceability of the other clauses.
ARTICLE 14: APPLICABLE LAW AND DISPUTES
These General Terms and Conditions of Sale and Use are governed by the laws of England and Wales. In the event of a dispute between the company and the customer, an amicable solution will be sought as a priority. In the absence of an amicable agreement, the dispute may be submitted to the competent courts of England and Wales.
ARTICLE 15: SUBSCRIPTIONS AND CANCELLATIONS
15.1 Subscription:
Certain services on the website are offered on a subscription basis. By subscribing, customers agree to recurring billing, with charges made according to the chosen payment method.
15.2 Cancellation:
Customers can cancel their subscription at any time by accessing their account on the “/my-account” page or by sending an email to [email protected]. For monthly subscriptions, the cancellation will take effect at the end of the current billing cycle.
15.3 Annual Pass Refunds:
You can request a refund for the annual pass. However, each started course will be deducted from your refund request at a fixed price equivalent to the individual course price. In case of a billing dispute, customers can contact customer service.
15.4 Monthly Pass Refund:
The Monthly Pass offers immediate access to all the courses offered on the website. Because of this immediate accessibility, no refunds will be made for the Monthly Pass. If you wish to stop your subscription, please refer to article 15.2 for the cancellation procedure.
ARTICLE 16: NON-REFUNDABLE WORKBOOKS AND DIGITAL MATERIALS
1. The Customer expressly acknowledges and agrees that all WorkBooks and digital materials sold on our Website are non-tangible digital content, transmitted digitally and immediately downloadable after purchase.
2. Due to the inherent nature of these products, which are digital and accessible upon purchase, all WorkBook and digital material purchases are considered as “firm sales”. This means that, except as otherwise specifically provided by applicable law, they are not eligible for refund or exchange once the purchase has been made.
3. Therefore, by accepting these terms and conditions of sale, the Customer acknowledges having been duly informed of this exception to the right of withdrawal and consequently accepts it.
4. If the Customer has questions or concerns about the product they are about to purchase, they have the possibility and full responsibility to contact our customer service for clarification before making their purchase.
5. Finally, we remind that under no circumstances can technical problems encountered by the user relating to format compatibility, download time, file loss or others engage the responsibility of our company.
ARTICLE 17: ACCEPTABLE CONDUCT CLAUSE AND RIGHT TO REFUSE SERVICE
In order to maintain a safe and respectful environment for all our customers and staff, Focus Scale Ltd reserves the right to refuse or restrict service to any customer whose behavior is deemed inappropriate, disruptive, or aggressive. If a customer continues to behave aggressively or inappropriately after all necessary information has been provided and reasonable attempts to resolve the situation have been exhausted, Focus Scale Ltd may decide to ban this customer from using our services, at our discretion. This decision is taken very seriously and is used only as a last resort.
We are committed to providing excellent service to all our customers, but we must also protect the safety and well-being of our staff and clientele. Additionally, Focus Scale Ltd reserves the right to refund customers at our discretion, in accordance with our general refund conditions posted in section 5.2. Any refund will be considered and processed fairly to ensure customer satisfaction while respecting our established standards and internal procedures.
